Who Can Use Benchie

• You must be at least 13 years old
• You must provide accurate information when creating an account
• You must not have been previously banned from Benchie
• You must comply with all applicable laws and regulations

Permitted Use

You may use Benchie to:

• Run benchmark tests on your computer systems
• View and compare benchmark results
• Participate in leaderboards and community features
• Export your data for personal use
• Access educational content and resources

Prohibited Use

You may not:

• Submit false, misleading, or fraudulent benchmark results
• Attempt to hack, reverse engineer, or compromise our systems
• Use automated tools to scrape or harvest data
• Share your account credentials with others
• Upload malicious content or attempt to harm other users
• Violate any applicable laws or regulations
• Impersonate others or create fake accounts

Fair Use Policy

We expect users to use our service reasonably. Excessive use that impacts service performance for others may result in rate limiting or account restrictions. We'll always communicate with users before taking action.

Your Content Ownership

You retain ownership of all content you create, upload, or submit to Benchie, including:

• Benchmark results and performance data
• Computer profiles and system configurations
• Comments, reviews, and community contributions
• Any other content you provide

License to Us

By submitting content to Benchie, you grant us a limited, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of providing our services. This includes:

• Displaying your benchmark results in leaderboards
• Generating aggregate statistics and insights
• Enabling comparisons with other users' data
• Providing customer support and technical assistance

Content Standards

All content must be accurate, legitimate, and not violate any third-party rights. We reserve the right to remove content that violates these standards or our community guidelines.

Subscription Plans

Benchie offers both free and paid subscription plans. Paid subscriptions provide additional features and increased usage limits. Current plan details and pricing are available on our pricing page.

Billing and Payments

• Subscriptions are billed monthly or annually as selected
• Payments are processed securely through Stripe
• All fees are in USD unless otherwise specified
• You're responsible for applicable taxes
• Failed payments may result in service suspension

Changes and Cancellation

• You can upgrade, downgrade, or cancel your subscription anytime
• Changes take effect at the next billing cycle
• Cancellations are effective at the end of the current billing period
• No refunds for partial months, except as required by law
• Downgrading may result in feature or usage limit changes

Price Changes

We may change subscription prices with at least 30 days notice. Existing subscribers will be grandfathered at their current price for at least one billing cycle.

Service Uptime

We strive to maintain high service availability but cannot guarantee 100% uptime. We may temporarily suspend service for maintenance, updates, or technical issues.

Changes to Service

• We may modify, update, or discontinue features at any time
• Major changes will be announced in advance when possible
• We may add new features or services without notice
• Beta features may be experimental and subject to change

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may also delete your account at any time through your account settings.

Service "As Is"

Benchie is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free.

Benchmark Accuracy

While we strive for accuracy, benchmark results may vary based on system configuration, software environment, and other factors. Results should be used for reference and comparison purposes.

Limitation of Liability

To the maximum extent permitted by law, Benchie shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the service in the past 12 months.

Third-Party Services

Our service may include links to or integrations with third-party services. We are not responsible for the content, policies, or practices of third-party services.

Security Measures

• We implement industry-standard security practices
• Your data is encrypted in transit and at rest
• We regularly monitor for security threats
• We will notify you of any significant security breaches

Your Responsibilities

• Keep your account credentials secure
• Report any suspicious activity immediately
• Use strong, unique passwords
• Do not share your account with others

Governing Law

These terms are governed by the laws of the United States and the state where Benchie is incorporated, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these terms or your use of Benchie will be resolved through binding arbitration, except for claims that may be brought in small claims court.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These terms, along with our Privacy Policy, constitute the entire agreement between you and Benchie regarding your use of the service.
